After enjoying a night out with mates, one of the females in our client’s group asked to join him in the uber ride back to his place. What he believed had been a mutually passionate encounter in his bedroom turned into a two year nightmare fighting allegations that he had sexually penetrated her in various ways, without her consent.
After analysing the evidence against our client, a cascade of inconsistencies and falsehoods began to emerge in the complainant’s version of events. Our client accepted our advice to plead not guilty to the charges and proceed to trial before a District Court jury maintaining that the sexual acts were consensual.
During a meticulously prepared and well executed cross examination of the complainant, her dishonesty was exposed. It became abundantly clear that she possessed a selective memory and would not let the truth get in the way of a good story. The fact that the jury took less than one hour in their deliberations after a week long trial, was testament to the unbelievable aspects of the complainant’s evidence. The verdicts of not guilty on all charges came as a relief to our client, supporters, and above all his mother, who tearfully embraced him as he emerged, free, from the dock of the court room.
